Monke Temple — Terms & Conditions
The English version of these Terms controls if there is any conflict between the English and Spanish versions.
PART I. INDIVIDUAL CLIENT TERMS & CONDITIONS (ENGLISH)
Effective Date: July 15, 2026
These Terms & Conditions (“Terms”) govern your access to and use of the Monke Temple website, services, programs, sessions, classes, digital materials, and related offerings for individual clients. By visiting our website, purchasing, booking, registering for, or participating in any Monke Temple offering, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the website or purchase or participate in our services.
1. Company Information
Monke Temple is operated by MT Conscious Ventures LLC, a Texas limited liability company, doing business as Monke Temple (“Monke Temple,” “we,” “us,” or “our”).

2. Scope of These Terms
These Terms apply to individual consumer offerings, including as applicable:
- the Mindfulness Journey program (1:1);
- the Mindfulness Circle group program;
- Mindfulness 1:1 Sessions, whether purchased as a single session or as a monthly pass;
- newsletter sign-up and other free resources; and
- your use of the Monke Temple website and booking and payment tools.
We may introduce additional individual offerings from time to time, including without limitation yoga, movement, or other wellbeing sessions, additional digital materials, or a content library. Any such additional offering is automatically governed by these Terms together with the specific inclusions, pricing, and any additional terms stated on its sales or checkout page, without requiring us to update this document first, except where we determine a material change requires one.
These Terms do not govern:
- custom corporate, team, enterprise, or organizational services, which are addressed separately through proposals, statements of work, service agreements, or similar documents (see Part II); or
- any retreat, in-person retreat, or destination travel program Monke Temple may offer now or in the future, which will be governed by a separate retreat-specific registration agreement made available at the time such an offering is sold.
3. Eligibility
Our services are intended only for individuals who are 18 years of age or older. By using the website or purchasing any offering, you represent and warrant that you are at least 18 years old and legally capable of entering into a binding agreement.
We may accept clients located outside the United States. You are responsible for ensuring that your use of our website and services is permitted in your jurisdiction, and, if you are located outside the United States, that receiving services from a U.S.-based provider is permitted where you live.
If we determine that a purchase or registration was made by someone who does not meet these eligibility requirements, we may cancel the applicable booking or access and, at our discretion, refund amounts paid, less the value of any sessions already delivered.
4. Nature of the Services
Monke Temple provides wellbeing, educational, and personal development offerings that may include mindfulness education, guided meditation, breath awareness practices, yoga or mindful movement, coaching-style support, reflections, and general wellbeing resources.
Our services are designed to support awareness, learning, self-reflection, and wellbeing. They are not clinical, diagnostic, therapeutic, psychiatric, or medical services.
All Monke Temple sessions and programs described in this Part I are delivered exclusively online via live video conferencing (currently Zoom) and related digital tools. We do not currently offer in-person individual sessions.
5. No Medical, Mental Health, or Emergency Services
Monke Temple does not provide medical advice, mental health treatment, psychotherapy, counseling, psychiatric services, physical therapy, or any other licensed healthcare services.
Our services:
- are not a substitute for a physician, therapist, psychologist, psychiatrist, licensed counselor, or other qualified healthcare professional;
- are not intended to diagnose, treat, cure, or prevent any disease, disorder, or medical or mental health condition;
- are not appropriate for crisis or emergency situations; and
- should not be relied on as a replacement for professional healthcare or mental health care.
If you are experiencing a medical issue, a mental health crisis, thoughts of self-harm, or any emergency, you must stop using the services and contact an appropriate licensed professional or emergency service immediately.
You are solely responsible for deciding whether to participate in any Monke Temple offering and for obtaining any medical, mental health, or other professional support you may need.
6. Voluntary Participation and Personal Responsibility
You participate in all Monke Temple services voluntarily and at your own discretion. You understand and agree that you are solely responsible for:
- your physical, mental, and emotional wellbeing;
- determining whether any practice, exercise, reflection, breath practice, movement, or session is appropriate for you;
- consulting a qualified healthcare professional before participating where appropriate, including if you are pregnant, injured, ill, recovering from illness or surgery, managing a physical or mental health condition, or have any other concern about participation; and
- stopping immediately if you experience pain, dizziness, shortness of breath, emotional overwhelm, distress, or any other sign that participation may be inappropriate for you.
7. Assumption of Risk
You understand that participation in mindfulness, breath awareness, yoga, stretching, active breaks, movement practices, reflective exercises, coaching-style conversations, and other wellbeing activities may involve inherent risks, including without limitation physical discomfort, muscle strain, aggravation of an existing condition, dizziness, falls, emotional discomfort, fatigue, or other known or unknown risks.
By participating, you knowingly and voluntarily assume all risks associated with your participation, whether physical, mental, emotional, technological, logistical, or otherwise, except to the extent such risks cannot legally be waived under applicable law.
You are responsible for participating within your own limits, modifying as needed, creating a safe physical environment for virtual participation, and using appropriate equipment and internet access.
8. Release and Waiver of Claims
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU RELEASE, WAIVE, AND DISCHARGE MT CONSCIOUS VENTURES LLC, MONKE TEMPLE, AND EACH OF THEIR MEMBERS, OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, FACILITATORS, TEACHERS, COACHES, AGENTS, REPRESENTATIVES, SUCCESSORS, AND ASSIGNS FROM ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, LOSSES, COSTS, OR LIABILITIES ARISING OUT OF OR RELATED TO YOUR PARTICIPATION IN ANY MONKE TEMPLE OFFERING, INCLUDING CLAIMS ARISING FROM ORDINARY NEGLIGENCE, EXCEPT TO THE EXTENT SUCH CLAIMS CANNOT LEGALLY BE WAIVED OR LIMITED UNDER APPLICABLE LAW.
This release includes, without limitation, claims arising from personal injury, emotional distress, illness, property damage, interruption of service, technology failure, platform failure, loss of data, or dissatisfaction with results.
Nothing in these Terms excludes liability for gross negligence, willful misconduct, fraud, or any liability that cannot be excluded under applicable law.
9. No Guarantee of Results
Monke Temple does not guarantee any specific outcome, transformation, emotional state, health improvement, behavioral change, business result, spiritual result, or personal result from participation in any offering.
Any examples, testimonials, illustrations, descriptions, or statements regarding possible benefits are provided for informational purposes only. Results vary from person to person and depend on many factors outside our control, including your own participation, consistency, health, circumstances, environment, and personal history.
10. Booking, Payment, and Checkout
Bookings and payments for eligible individual offerings are made through our website and designated third-party tools, including without limitation our scheduling platform and payment processor.
By submitting payment information, you represent and warrant that you are authorized to use the selected payment method.
Unless otherwise stated at checkout:
- payment is due in full at the time of purchase;
- a booking is not confirmed until payment is successfully processed;
- all prices are displayed on the website at the time of purchase;
- current checkout pricing is the amount charged at the time of purchase; and
- pricing may change at any time for future purchases without notice.
If a pricing error, technical error, or payment processing error occurs, we reserve the right to cancel the affected order and issue an appropriate refund.
Payment Disputes and Chargebacks. If you believe you were charged in error or are dissatisfied with a purchase, please contact us at team@monketemple.com before initiating a chargeback or payment dispute with your bank or card provider, so we have an opportunity to resolve the issue directly. Initiating a chargeback for a service that was delivered, made available, or scheduled in accordance with these Terms may result in suspension of your access to current or future Monke Temple offerings. We reserve the right to contest any chargeback and to recover unpaid amounts, including associated fees, to the extent permitted by law.
Currency and Cross-Border Fees. Unless otherwise stated, all prices are shown and charged in U.S. dollars. If your payment method or bank is based outside the United States, your card issuer or bank may apply currency conversion charges, cross-border transaction fees, or other charges. These are your responsibility and are not included in the price shown at checkout.
11. Taxes
At this time, amounts shown at checkout for these offerings are charged as the final checkout price unless taxes are required by law to be added or collected.
12. Choose-What-You-Pay Pricing
Certain offerings, including the Mindfulness Journey and Mindfulness Circle programs, use a choose-what-you-pay pricing model with multiple available rates (for example, tiers presented on the sales page as a lower community-supported rate, a standard rate, and a higher supporter rate).
Unless expressly stated otherwise, all available rates provide access to the same core program and inclusions: a higher tier does not unlock additional sessions, materials, or features, and a lower tier is not a discounted or partial version of the program.
By selecting a rate, you acknowledge that you are voluntarily choosing your contribution level from the available options presented at checkout.
13. Individual Service-Specific Terms
Sales pages and checkout pages describe the current inclusions, format, and pricing of each offering below. If anything in this Section 13 conflicts with the specific sales or checkout page presented to you for the offering you purchased, the terms presented to you at checkout at the time of your purchase control for that purchase.
A. Mindfulness Journey (1:1 Program)
Unless otherwise stated on the sales page, the Mindfulness Journey includes:
- 8 live 1:1 sessions via Zoom, approximately 90 minutes each;
- guided audio recordings, exercises, and reflection materials for practice between sessions;
- WhatsApp support between sessions, where included; and
- 2 optional post-program follow-up sessions of approximately 60 minutes each.
Program timing rules:
- You choose your own scheduled day and time for each session, subject to teacher availability.
- You must leave at least 7 days between consecutive sessions to allow time for practice and integration, unless we agree otherwise in a specific case.
- You must complete all 8 core sessions within 3 months of Session 1.
- If follow-up sessions are included, they must be used within 2 months of Session 8.
- Sessions or follow-up sessions not used within these timing windows are forfeited and are not refundable or extendable except at our discretion.
Rescheduling and no-show rules:
- You may cancel or reschedule a scheduled session by giving at least 24 hours’ prior notice, provided the rescheduled session still falls within the applicable timing window above.
- If you arrive more than 15 minutes late, or do not attend, the session is treated as a no-show and is forfeited.
- If you arrive late but the session can still reasonably proceed, it may end at its originally scheduled time.
Refund policy:
- 100% refund available up to 24 hours before Session 1.
- 85% refund available after Session 1 and up to 24 hours before Session 2.
- No refunds are available after that point, including for sessions not yet used, except as required by law.
B. Mindfulness Circle (Group Program)
Unless otherwise stated on the sales page, the Mindfulness Circle includes:
- 8 live group sessions via Zoom, approximately 90 minutes each, held approximately weekly;
- a maximum group size as stated on the sales page (currently up to 6 participants);
- guided audio recordings, exercises, and reflection materials for practice between sessions; and
- teacher-coach guidance and peer community support during sessions.
Group-program rules:
- Your purchase reserves a place in a specific group cohort with a fixed start date and weekly schedule.
- Because you are purchasing participation in a scheduled group experience alongside other participants, individual rescheduling of a specific session is not available.
- If you miss a session, it is forfeited and is not refundable, replaceable, or transferable, unless we expressly state otherwise in writing, or unless Section 14 (If Monke Temple Must Cancel or Reschedule) applies.
Refund policy:
- 100% refund available up to 24 hours before the first session of your cohort.
- 85% refund available after Session 1 of your cohort and up to 24 hours before Session 2.
- No refunds are available after that point, except as required by law.
C. Mindfulness 1:1 Sessions (Single Sessions and Monthly Passes)
Unless otherwise stated on the sales page, Mindfulness 1:1 Sessions are private live 60-minute sessions delivered by Zoom, and may be purchased as:
- a single session; or
- a monthly pass covering a stated number of sessions (currently 2 or 4) to be used within one calendar month, as described on the sales page.
Monthly passes are one-time purchases. They do not automatically renew, and no recurring or subscription billing currently applies to Mindfulness 1:1 Sessions.
Scheduling rules:
- Sessions are scheduled based on mutual availability.
- For a monthly pass, all included sessions must be scheduled and completed within one calendar month of the date of purchase (or of the first session in the pass, whichever your checkout page specifies). Sessions not used within that period are forfeited and do not roll over to a future month, unless we expressly agree otherwise.
Rescheduling and no-show rules:
- You may cancel or reschedule any scheduled session with at least 24 hours’ prior notice, provided the rescheduled session still falls within the applicable period above.
- If you arrive more than 15 minutes late, or do not attend, the session is forfeited.
- If the session proceeds after a late arrival, it may still end at the originally scheduled time.
Refund policy:
- Single session: 100% refund available up to 24 hours before the scheduled session; no refund is available after that point.
- Monthly pass: 100% refund available before your first session in the pass takes place. Once your first session in the pass has taken place, the pass is deemed activated and the remaining sessions in that pass are non-refundable, though still usable within the applicable timing window above.
D. Digital Materials Included with Paid Programs
Guided audios, worksheets, reflections, and similar materials provided as part of the Mindfulness Journey, Mindfulness Circle, or Mindfulness 1:1 Sessions are licensed to you for your personal, non-commercial use only, as further described in Section 19 (Intellectual Property and Limited License). Because these materials are made available to you as part of your program, they are not separately refundable apart from the program of which they are a part.
E. Other or Future Individual Offerings
If Monke Temple makes any other individual offering available on the website that is not specifically addressed above (for example, yoga or movement sessions, a standalone content library, or other new formats), that offering is governed by these Terms generally, together with any specific inclusions, timing rules, and refund policy stated on its sales or checkout page. In the absence of a stated refund policy for a new offering, the refund structure in subsection C above (single-session/short-form offerings) applies by default until we state otherwise.
14. If Monke Temple Must Cancel or Reschedule
We reserve the right to cancel, postpone, reschedule, substitute facilitators, adjust program dates, adjust session times, or modify delivery format where reasonably necessary, including for illness, emergency, scheduling conflicts, low enrollment, technical issues, safety concerns, force majeure events, or circumstances outside our reasonable control.
If Monke Temple must cancel or reschedule:
- for a 1:1 session, we will generally offer you a rescheduled session at no additional cost;
- for a group session, we may reschedule the session, add a make-up session, extend the program, or provide a prorated credit or refund for the canceled portion, at our discretion unless otherwise required by law;
- if we are unable to deliver a purchased service in a commercially reasonable manner, we may issue a full or partial refund for the affected unused portion.
A change of facilitator, date, time, or format that does not materially reduce the purchased offering does not by itself entitle you to a refund.
15. Expiration, Forfeiture, and Non-Transferability
Unless otherwise expressly stated in writing:
- purchased sessions, packages, and program access expire according to the applicable offer rules;
- expired or unused sessions are forfeited;
- purchases are personal to the buyer or enrolled participant;
- purchases may not be transferred, assigned, shared, resold, or substituted without our prior written consent.
16. WhatsApp, Email, and Communications
Where support or communications are included, you consent to receive service-related communications from Monke Temple by email, WhatsApp, and other contact methods you provide, for purposes such as scheduling, support, logistics, reminders, access information, and customer service.
Enrollment in our newsletter or marketing communications is optional and subject to your communication preferences and applicable law.
17. Session Conduct and Participation Rules
You agree to participate respectfully and lawfully. You may not:
- disrupt sessions or group spaces;
- harass, threaten, or discriminate against any participant, facilitator, or representative;
- attend under the influence of substances in a way that impairs safe participation;
- misuse Zoom links, group access, chat functions, or support channels; or
- use the services for unlawful, exploitative, defamatory, or harmful purposes.
We reserve the right to suspend, remove, or refuse participation without refund where we reasonably determine that your conduct is unsafe, unlawful, abusive, disruptive, or inconsistent with the integrity of the offering.
18. No Recording Policy
Sessions are not recorded by Monke Temple unless we expressly notify you otherwise in writing.
You may not record, photograph, screenshot, film, livestream, reproduce, or distribute any session, class, conversation, chat, materials, or part of the services without our prior written permission.
19. Intellectual Property and Limited License
All content and materials provided by Monke Temple, including without limitation text, branding, logos, graphics, videos, audios, meditations, worksheets, PDFs, course structures, program designs, methods, content library materials, and Monke Temple’s signature wellbeing framework and related concepts, are owned by or licensed to Monke Temple and are protected by applicable intellectual property laws.
Subject to your compliance with these Terms, Monke Temple grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use purchased or provided materials solely for your own personal, non-commercial use.
You may not, without prior written permission:
- copy, reproduce, modify, translate, publish, upload, distribute, transmit, display, sell, license, sublicense, or create derivative works from any Monke Temple content;
- share audios, PDFs, worksheets, videos, Zoom links, or content library access with any third party;
- use Monke Temple content, methods, or signature wellbeing framework commercially or in connection with your own services, training, business, or product;
- remove copyright, trademark, attribution, or proprietary notices; or
- repost testimonials, client content, or Monke Temple content without permission.
20. Testimonials and User Submissions
If you submit a testimonial, review, comment, image, feedback, or similar material to Monke Temple, you represent that it is truthful, based on your genuine experience, and does not violate the rights of any third party.
If you separately grant us written permission, Monke Temple may use your testimonial for business, editorial, promotional, and marketing purposes in accordance with that permission. Where permitted by you, testimonials may be edited for length, grammar, clarity, or formatting, provided the overall meaning is not materially changed.
Where agreed, Monke Temple may identify a testimonial using your first name, last-name initial, country, and profile photo provided by you.
21. Website Use
You agree to use the website lawfully and only for legitimate informational, booking, or purchasing purposes. You may not:
- interfere with website operation or security;
- attempt unauthorized access to accounts, tools, or data;
- scrape, copy, mirror, or mine website content without permission;
- submit false information; or
- use the website in a way that could damage Monke Temple or other users.
We may suspend, restrict, or terminate website access at any time for security, operational, legal, or business reasons.
22. Third-Party Tools and Services
The website and services may rely on third-party tools or platforms, including without limitation scheduling, payment, email, messaging, video conferencing, hosting, analytics, or content delivery tools. Monke Temple is not responsible for the acts, omissions, downtime, policies, or failures of third-party providers.
Your use of third-party tools may also be subject to the terms and privacy practices of those providers.
23. Privacy and Personal Information
Your privacy is important to Monke Temple. Our collection, use, storage, and disclosure of personal information are described in our separate Privacy Policy, which is incorporated into these Terms by reference.
When you use the Monke Temple website, register for an offering, book a session, make a purchase, submit a form, subscribe to communications, or otherwise interact with our services, we may collect information that you voluntarily provide, such as your name, email address, phone number, billing information, booking information, communications, and other information necessary to provide and administer our services.
We may also automatically collect certain technical and usage information when you interact with our website or digital services, including information about your device, browser, IP address, pages viewed, interactions with the website, and similar information. We may use cookies, pixels, analytics tools, and similar technologies for purposes such as website functionality, security, performance, analytics, communications, and improving our services.
We may use personal information for purposes including:
- providing, scheduling, administering, and supporting our services;
- processing payments and managing purchases;
- communicating with you regarding bookings, sessions, programs, support, and service-related matters;
- sending newsletters or marketing communications where permitted and in accordance with your preferences;
- maintaining, securing, and improving our website and services;
- understanding how visitors use our website and improving user experience; and
- complying with applicable legal obligations and protecting our legal rights.
We may use third-party service providers to support website operation and service delivery, including without limitation payment processors, scheduling platforms, email and messaging providers, video-conferencing platforms, hosting providers, analytics providers, and other technology providers. These providers may process personal information on our behalf or independently in accordance with their own applicable terms and privacy practices.
We do not sell your personal information for monetary consideration. We may disclose information where reasonably necessary to provide our services, operate our business, comply with legal obligations, respond to lawful requests, protect our rights or users, or as otherwise described in our Privacy Policy.
You are responsible for ensuring that information you provide to Monke Temple is accurate and that you have the right to provide any information relating to another person.
Our Privacy Policy may provide additional information regarding the categories of information we collect, the purposes for which we use it, cookies and similar technologies, third-party services, data retention, your privacy rights, and how to contact us regarding privacy matters.

By using the website or services, you acknowledge that you have been provided with the opportunity to review our Privacy Policy. Where applicable law requires a separate consent or acknowledgment, we will obtain that consent separately.
24. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE, SERVICES, SESSIONS, PROGRAMS, DIGITAL MATERIALS, CONTENT, AND ALL RELATED OFFERINGS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
MONKE TEMPLE DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, QUIET ENJOYMENT, AND THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR SUITABLE FOR YOUR PARTICULAR NEEDS.
25. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MONKE TEMPLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, OPPORTUNITY, GOODWILL, DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE WEBSITE, THE SERVICES, YOUR PARTICIPATION, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF MONKE TEMPLE ARISING OUT OF OR RELATED TO ANY CLAIM, SERIES OF CLAIMS, OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO MONKE TEMPLE FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY.
Nothing in these Terms limits liability that cannot legally be limited, including liability for gross negligence, willful misconduct, or fraud where applicable law prohibits such limitation.
26. Indemnification
You agree to defend, indemnify, and hold harmless MT Conscious Ventures LLC, Monke Temple, and their members, owners, officers, directors, employees, contractors, facilitators, coaches, teachers, agents, and representatives from and against any third-party claims, demands, actions, proceedings, damages, liabilities, judgments, settlements, penalties, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- your breach of these Terms;
- your misuse of the website or services;
- your violation of any law or third-party right; or
- your negligent, reckless, unlawful, or harmful conduct.
27. Force Majeure
Monke Temple will not be liable for any delay, interruption, cancellation, or failure to perform resulting from causes beyond our reasonable control, including without limitation illness, acts of God, natural disasters, severe weather, power outages, internet or platform failures, labor disputes, pandemics, government action, war, civil unrest, or other force majeure events.
28. Termination
We may suspend or terminate your access to the website or services, or cancel your participation in any offering, at any time and without prior notice if we reasonably believe you have violated these Terms, created risk or harm, engaged in misuse, or acted unlawfully or abusively.
Any provisions that by their nature should survive termination shall survive, including without limitation provisions relating to payment obligations, intellectual property, disclaimers, liability limitations, indemnification, dispute resolution, and governing law.
29. International Consumers; Your Statutory Rights
Monke Temple is based in the United States and these Terms are written primarily around U.S. law. Because we welcome clients from around the world, this section explains how these Terms interact with mandatory consumer-protection laws that may apply where you live.
Nothing in these Terms is intended to exclude, limit, or waive any right you have under mandatory consumer-protection law in your country or state of residence that cannot lawfully be excluded, limited, or waived by agreement. If any provision of these Terms would otherwise conflict with such a mandatory right, that provision applies only to the extent permitted by that law, and your statutory right otherwise controls for your purchase.
EU/UK/EEA Digital Content and Immediate-Performance Acknowledgment. If you are a consumer located in the European Union, the United Kingdom, or another jurisdiction that grants a statutory right to withdraw from a distance contract within a set period (commonly 14 days), the following applies to any Monke Temple session, program, or digital material scheduled or made available to you within that period: by booking a session, enrolling in a program with a start date inside that period, or accessing downloadable or streamed digital materials, you expressly request that we begin performance immediately, and you acknowledge that, to the extent permitted by applicable law, you will lose your statutory withdrawal right once we have fully performed the service or once your access to the digital content has begun, whichever applies. Where required by your local law, we will seek your explicit confirmation of this request at checkout, separate from your general acceptance of these Terms.
This section does not reduce any of the specific refund, rescheduling, or cancellation terms in Section 13, which remain available to you in addition to, not instead of, any mandatory statutory right that applies to you.
30. Dispute Resolution; Governing Law; Venue
These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law principles, except to the extent Section 29 requires otherwise for a given consumer.
Before filing a formal claim, you agree to first email Monke Temple at team@monketemple.com with a written notice describing the dispute and to make a good-faith effort to resolve the matter informally for at least 30 days.
If a dispute is not resolved informally, then, to the fullest extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms, the website, or any Monke Temple service shall be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect (or, if the AAA is unavailable, a comparable arbitration provider applying substantially similar consumer-protective rules). The arbitration will be conducted in Harris County, Texas, or remotely if permitted by the applicable rules and agreed by the parties.
You and Monke Temple each waive any right to participate in a class action, collective action, consolidated action, or representative proceeding, and agree that claims must be brought only in an individual capacity. If this class-, collective-, and representative-action waiver is found unenforceable with respect to a particular claim or dispute, then that particular claim or dispute (and only that claim or dispute) shall be severed from arbitration and may proceed in the courts identified below, while this arbitration provision continues to apply to all other claims and disputes.
Either party may bring an individual claim in small claims court if the claim qualifies. Either party may also seek temporary or preliminary injunctive relief in a court of competent jurisdiction to protect intellectual property, confidential information, or other rights pending final resolution.
If the arbitration provision above is held unenforceable as to any dispute, then exclusive venue for that dispute shall lie in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of those courts.
Nothing in this Section 30 overrides Section 29 (International Consumers; Your Statutory Rights) for consumers protected by mandatory local law that cannot be displaced by agreement.
31. English Controls
These Terms may be translated into languages other than English for convenience. In the event of any conflict, inconsistency, or ambiguity between the English version and any translated version, the English version controls.
32. Changes to These Terms
We may update or modify these Terms at any time in our discretion. The version posted on the website will be the current version and will become effective as stated by the updated effective date.
For purchases already made, the version in effect at the time of your purchase generally applies to that purchase unless a change is required by law or expressly accepted by you.
33. General Provisions
If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.
Our failure to enforce any provision shall not be deemed a waiver.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, restructuring, sale, or transfer of business assets.
These Terms, together with any policies, offer pages, order forms, checkout terms, and written service-specific terms incorporated by reference, constitute the entire agreement between you and Monke Temple regarding the subject matter covered here.
